Please read these Terms carefully before placing an order or using this website. By accessing restored-audio.com or purchasing any product, you agree to be bound by these Terms. If you do not agree, do not use this website or place an order.

Who We Are

This website, restored-audio.com (the "Site"), is operated by 1337 Adventures LLC ("Company," "we," "us," or "our"). Our contact email is contact@restored-audio.com.

Restored Audio is an independent retailer of restored vintage consumer electronics. We are not affiliated with, authorized by, sponsored by, or in any way officially connected with Apple Inc. All Apple product names are trademarks of Apple Inc. References to iPod or Apple are made solely for descriptive purposes.

Eligibility

You must be at least 18 years of age to place an order or use this Site. By using the Site you represent that you are 18 or older and have the legal capacity to enter into a binding contract. If you are under 18, you may only use the Site with the direct supervision of a parent or legal guardian who agrees to these Terms on your behalf.

Products and Pre-Orders

We sell pre-owned, professionally restored vintage Apple iPod devices. Each device is a genuine used Apple product that has been disassembled, cleaned, repaired, and rebuilt by our technicians. Products are not new, are not sold by Apple, and may exhibit cosmetic wear consistent with the age of the original hardware (minor scratches, slight discoloration, etc.) unless otherwise stated in the product listing.

Product availability is limited. Placing a reservation does not guarantee availability. In the rare event we cannot fulfill your order, we will notify you and issue a full refund of all amounts paid, including the deposit.

Product images are representative. Actual appearance may vary slightly due to the restored nature of vintage hardware and individual device characteristics.

Our products are intended for personal, non-commercial use as standalone music devices. We make no guarantee of compatibility with any specific streaming service, digital rights management (DRM) system, third-party application, or accessory. Compatibility with external accessories (cables, docks, speakers, etc.) depends on the hardware generation and is the buyer's responsibility to verify.

Pricing and Payment

All prices are set in United States Dollars (USD). The purchase price for standard iPod builds is $449.00 USD, charged in full at the time of order. Free worldwide shipping is included on all orders.

Local currency. If you are outside the United States, this site may display the price converted into your local currency, and Stripe may offer to charge you in that currency at checkout. Converted figures use Stripe's current exchange rate, which includes Stripe's currency conversion fee, and are shown for your convenience only. Exchange rates move, so a converted figure shown on this site is an estimate until you reach checkout — the amount shown on the Stripe checkout page is the amount you will be charged. Your bank or card issuer may apply its own fees on top.

Prices are subject to change at any time prior to your order being placed. Once payment is collected, the price of your specific order is locked.

All payments are processed securely by Stripe, Inc. We do not store, view, or have access to your full card number, CVV, or other sensitive payment credentials. By providing payment information, you agree to Stripe's Terms of Service and Privacy Policy. In the event of a payment dispute or chargeback, we reserve the right to suspend or terminate your order and pursue recovery of any amounts already disbursed.

You are responsible for any applicable sales tax, VAT, customs duties, or import fees imposed by your country or jurisdiction. For international orders, customs charges are the buyer's sole responsibility.

Cancellation and Refund Policy

All sales are final. By submitting an order, you acknowledge and agree that payment will not be returned to you under any circumstances if you cancel your order.

If you wish to cancel your order before your device has shipped, you may do so by contacting us at contact@restored-audio.com. Cancellations requested before production has begun may be eligible for a refund at our discretion.

After your device has shipped: We do not accept cancellations or issue refunds except as required by the 30-Day Limited Warranty described in Section 7, or as required by applicable law.

If we cancel your order for any reason (supply constraints, quality control failure, etc.), you will receive a full refund of all amounts paid within 5–10 business days.

Initiating a credit card chargeback without first contacting us constitutes a breach of these Terms. We reserve the right to contest all chargebacks and may provide transaction records, communications, and this agreement to your card issuer.

Shipping and Delivery

We offer free worldwide shipping on all orders. Shipping is fulfilled from our facility once your device has passed our quality control process.

Estimated delivery windows provided at checkout or via email are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs authorities, weather, or other circumstances beyond our control.

Risk of loss and title for products pass to you upon our delivery of the product to the carrier. Once a shipment is handed to the carrier, we are not responsible for lost, stolen, or damaged packages, though we will make reasonable efforts to assist in filing a carrier claim.

For international shipments, you are the importer of record and are responsible for complying with all applicable import laws and regulations. We are not responsible for seizure, delay, or additional charges imposed by customs.

30-Day Limited Warranty

We warrant each restored iPod against defects in materials and workmanship under normal use for a period of 30 days from the date of delivery to the original purchaser ("Warranty Period").

To obtain warranty service, contact us at contact@restored-audio.com within the Warranty Period with your order number and a description of the issue. We will, at our sole discretion, repair or replace the defective product, or issue a full refund. We pay for return shipping for valid warranty claims.

AFTER THE 30-DAY WARRANTY PERIOD EXPIRES, ALL PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Disclaimer of Warranties

EXCEPT FOR THE 30-DAY LIMITED WARRANTY EXPRESSLY SET FORTH IN SECTION 7, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 1337 ADVENTURES LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE SITE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 1337 ADVENTURES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR THE COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR ORDER SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless 1337 Adventures LLC and its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or property right; or (d) any claim that your conduct caused damage to a third party.

Intellectual Property

All content on this Site — including text, graphics, logos, images, audio clips, digital downloads, and software — is the property of 1337 Adventures LLC or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from this Site without our prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for personal, non-commercial purposes in accordance with these Terms.

Third-Party Links and Services

This Site may contain links to third-party websites or services (including Stripe for payment processing). We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk and governed by their respective terms and privacy policies.

Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Site shall be governed by and construed in accordance with the laws of the State of Massachusetts, without regard to its conflict of law provisions.

Informal Resolution: Before filing any formal legal claim, you agree to first contact us at contact@restored-audio.com and attempt to resolve the dispute informally. We will attempt to resolve it within 30 days.

Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the Site or Products, shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA) in effect at the time, except as otherwise provided herein. The arbitration shall be conducted in Massachusetts. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Nothing in this Section prevents either party from seeking injunctive or other equitable relief in court for alleged infringement of intellectual property rights, or as necessary to prevent irreparable harm.

Class Action Waiver

YOU AND 1337 ADVENTURES LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Unless both you and we agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will indicate the date of the most recent update at the top of this page. If we make material changes, we will make reasonable efforts to notify you (such as posting a notice on the Site or sending an email to the address associated with your order). Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

Miscellaneous

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1337 Adventures LLC with respect to the Site and your orders, and supersede all prior and contemporaneous agreements.

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.

Force Majeure. We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, supply chain disruptions, or government actions.
